Mr. David Soldani, Attorney AALRR will provide a presentation on the process and timeline for creating trustee areas.
 
Only districts that elect by-trustee areas are immune from California Voting Rights Act ("CVRA") liability. The CVRA defines at-large elections as a methodology where candidates must simply reside in the District and are voted on by all of the District's voters. Ed. Code § 5030(a). The District currently uses an at-large system of electing its Board members. 
 
Action Item- Approve Resolution 21-22-8 Initiating Process of Establishing Trustee Areas and Elections by Trustee Areas
 
 
The District wishes to ensure compliance with the California Voting Rights Act (CVRA) or, at minimum, avoid the potential for costly litigation under the CVRA.  In furtherance of this objective, the District intends to make the transition to a by-trustee area method of election in time for the next governing board member election in November of 2022.

NOTICE IS HEREBY GIVEN that the Governing Board of the Fillmore Unified School District at its regularly scheduled meeting on April 5, 2022, at 6:30 p.m. will invite public input regarding the composition of trustee areas prior to the initiation of the map-drawing process.

The public hearings scheduled for April 5, 2022 and April 19, 2022, are for the purposes of receiving public input regarding the composition of the trustee areas to be formed and the criteria the demographer will be directed to consider in drafting trustee areas.

At the Board meeting of March 1, 2022, the Board adopted Resolution No. 21-22-08 directing the Superintendent and/or his designee, among other things, to initiate the process of changing the method of electing members of the Board, from the current at-large system whereby each member of the Board is elected by the registered voters of the entire District (Education Code section 5030(a)), to a method which provides that Board members residing in each trustee area will be elected by the registered voters of that particular trustee area (Education Code 5030(b)), in sufficient time for the new method of electing members of the Board to be in place for the November 2022 election.
Elections Code section 10010(a)(1) requires the District to hold at least two public hearings to invite community input regarding the composition of the trustee areas over a period not to exceed 30 days. “Composition of the trustee areas” includes factors such as visible natural and man-made geographical and topographical features, communities of interest, jurisdictional boundaries and population growth.  The first such hearing was held on April 5, 2022. This is now the second such hearing.
Elections Code section 10010(a)(1) encourages political subdivisions to conduct outreach to the public, including to non-English-speaking communities, to explain the districting process and to encourage public participation. As such, the District has made notices regarding the process available in additional languages. [Spanish] To encourage public participation, the District has reached out to the public via social media, local newspaper, Fillmore Gazette and added a link to its webpage regarding the transition process:

In addition, the District made large maps available for public viewing and comments at the district office beginning on April 27, 2022.
